By visiting our site or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including all policies referenced herein.
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose. A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, or exploit any portion of the Service without express written permission from us. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 3 – ACCURACY, PRICING & CORRECTIONS
We are not responsible if information on this site is inaccurate, incomplete, or outdated. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information (including pricing) is inaccurate at any time without prior notice, even after an order has been submitted.
SECTION 4 – MODIFICATIONS TO SERVICE AND PRICES
Prices for our products are subject to change without notice. We shall not be liable to you or any third-party for any modification, price change, or discontinuance of the Service.
SECTION 5 – SHIPPING, DELIVERY & RISK OF LOSS
Origin: All products ship from Lafayette, Indiana, USA.
Carriers: We ship via UPS or FedEx at our sole discretion. We do not ship to P.O. Boxes, APO, or FPO addresses.
Fees: Free shipping for orders over $150 (excl. AK/HI). Alaska & Hawaii: $30 flat fee. Continental US under $150: $14.95.
Risk of Loss: The risk of loss and title for all items pass to you upon our delivery of the goods to the carrier (UPS/FedEx).

SECTION 6 – SALES TAX
Sales tax will be applied to orders based on the shipping destination and applicable state laws in effect at the time of purchase.
SECTION 7 – FRAUD PREVENTION & RISK ASSESSMENT
We reserve the right to cancel any order flagged as Medium or High Risk by our fraud detection systems. We may request additional verification or refuse fulfillment at our sole discretion. Canceled orders will be refunded to the original payment method.

SECTION 9 – RETURNS & REFUNDS
Returns are governed exclusively by our Refund Policy.
Return Costs: Unless the return is due to our error (e.g., wrong item shipped), all return shipping costs are the sole responsibility of the customer.
No Prepaid Labels: We do not provide prepaid return labels.
Non-Refundable: Original shipping costs are non-refundable. Refused or undeliverable shipments may be subject to deductions.
SECTION 10 – REPAIRS & SERVICE
All repairs are handled by J.L. Hufford, Lafayette, IN. Repairs are not free of charge unless explicitly covered by a valid warranty. Inspection fees, repair costs, and shipping may be charged to the customer.
SECTION 11 – PROHIBITED USES
In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to infringe upon our intellectual property; (c) to upload viruses or malicious code; (d) to collect or track the personal information of others; or (e) to "scrape", "crawl", or "spider" the site for any data.
SECTION 12 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The Service and all products are provided 'as is' and 'as available' without any warranties of any kind, either express or implied. In no case shall Pro-Ver (U.S.), LLC, our directors, or partners be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages (including lost profits) arising from your use of the Service or products. Our liability shall be limited to the maximum extent permitted by law.
SECTION 13 – INDEMNIFICATION
You agree to indemnify and hold harmless Pro-Ver (U.S.), LLC and our partners, service providers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to your breach of these Terms.
SECTION 14 – SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed to be severed. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 15 – TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement. These Terms are effective unless and until terminated by either you or us. If in our sole judgment you fail to comply with any term, we may terminate this agreement at any time without notice and deny you access to our Services.
SECTION 16 – ENTIRE AGREEMENT
These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us, superseding any prior or contemporaneous agreements, communications, and proposals (whether oral or written).
SECTION 17 – BINDING ARBITRATION & CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. Any dispute or claim relating in any way to your use of this site or products sold by bamix.us shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Venue: The arbitration shall take place in Delaware.
No Class Actions: You and bamix agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
